The Fort Mill School District<\/a> has agreed to pay a $200,000 settlement in a lawsuit<\/a> filed by the family of a crossing guard who died<\/a> after being hit by a car in 2024, York County court records show.<\/p>\n

Stanley Brucker, 61, was working as a guard on Springfield Parkway in March 2024 outside Fort Mill Middle and Fort Mill Elementary schools when he was hit and died. Prosecutors declined to press charges after they said school bus video showed Brucker stepped into the road.<\/p>\n

Brucker was working for a private company the school district contracts with for crossing guards.<\/p>\n

Later in 2024, Brucker\u2019s family filed a wrongful death lawsuit against the school district. The school district continues to deny civil liability<\/a>, according to the petition filed in late June and other court records. However, it has agreed to the $200,000 payment that would \u201ccompromise and settle all the claims,\u201d the settlement petition states.<\/p>\n

Matt Jepertinger<\/a>, one of the lawyers representing the Brucker family from the Charleston Duffy & Young firm<\/a>, told The Herald that civil claims against public bodies have legal limits.<\/p>\n

\u201cWhile no amount of money can undo the loss this family has suffered, we hope this resolution provides the family with some measure of closure,\u201d Jepetinger said. \u201cThis case highlights the difficult realities families can face when pursuing claims involving public entities as South Carolina law places statutory limits on the amount that can be recovered from public entities, regardless of the severity of the harm or the losses suffered. We appreciate the efforts of everyone involved in reaching this amicable resolution and hope that this case will serve as a catalyst for meaningful changes that prioritize the safety of crossing guards across South Carolina.\u201d<\/p>\n

Fort Mill schools spokesman Joe Burke referred all questions about the case to the district\u2019s attorneys. The Herald has reached out to the lawyers for the school district by phone and email but has not yet received a statement.<\/p>\n

A South Carolina circuit judge must now approve the settlement to make it final, but a hearing has not yet been scheduled.<\/p>\n

Fort Mill schools have grown so quickly in the past decade that it now has the largest district in York County with 21 campuses serving around 19,000 students. There have been several crossing guard traffic incidents<\/a> over the years in Fort Mill<\/a>.<\/p>\n

Brucker\u2019s March 2024 death was the first of two crossing guard collisions in 2024. In October 2024, a crossing guard working outside Catawba Ridge High School was hurt in a vehicle crash.<\/p>\n

After requests from the community poured in demanding better safety following the two crashes, The S.C. Department of Transportation upgraded safety measures outside both schools where the crashes happened.<\/p>\n

The first day of school this year is Aug. 3.<\/p>\n

Burke said the district will have crossing guards at designated crosswalks from an outside company, and \u201ctraffic guards at key locations provided through our agreements with local law enforcement similar to last year.\u201d<\/p>\n

Fort Mill Police Department<\/a> spokesman Capt. Steven Bivins said officers will assist again this year outside several school locations.<\/p>\n

Additionally, Bivins said the police department, in an agreement with the school district, has two dedicated traffic enforcement officers whose primary focus will be school zone safety, traffic flow, congestion reduction, and providing an additional public safety resource during peak traffic periods and major school events.<\/p>\n
