A Charlotte-Mecklenburg Schools official says the ban on diversity, equity and inclusion programs in public schools passed into law Wednesday won\u2019t have much of an impact on the district.<\/p>\n

CMS Executive Director of Intergovernmental Relations Charles Jeter does, however, worry about \u201cunintended consequences\u201d of the legislation, he told The Charlotte Observer Friday.<\/p>\n

Lawmakers in the North Carolina House of Representatives Wednesday overrode Gov. Josh Stein\u2019s veto of Senate Bill 227, \u201cEliminating \u2018DEI\u2019 in Public Education.\u201d It completed a veto override process that first started last summer with a 30-19 state Senate vote. The override comes amid a wave of recent anti-DEI bills in nearby states<\/u><\/a> South Carolina, Georgia, Tennessee and Virginia.<\/p>\n

The legislation bans public schools from using \u201cdiscriminatory practices\u201d or teaching \u201cdivisive concepts.\u201d It defines 12 \u201cdivisive concepts,\u201d such as teaching \u201cOne race or sex is inherently superior to another race or sex,\u201d \u201cA meritocracy is inherently racist or sexist,\u201d or \u201cAny individual, solely by virtue of his or her race or sex, should feel discomfort, guilt, anguish, or any other form of psychological distress.\u201d<\/p>\n

It bars school districts from having specific offices or roles dedicated to \u201cdiversity, equity and inclusion.\u201d<\/p>\n

N.C. House Speaker Destin Hall applauded the override, stating that the legislation quashes \u201cdivisive DEI policies for good,\u201d in a Wednesday news release.<\/p>\n

Meanwhile, in his own news release, Stein accused lawmakers who overrode his veto of \u201cstoking culture wars\u201d and attempting to \u201cwhitewash the diversity that makes our state strong.\u201d<\/p>\n

CMS doesn\u2019t currently have any office or role specifically designated for \u201cdiversity, equity and inclusion,\u201d as the legislation forbids. Jeter said he doesn\u2019t see anything in the legislation that would require CMS to change its current practices.<\/p>\n

\u201cI don\u2019t believe we\u2019re doing any of that, so I just honestly don\u2019t believe that we have anything right now that we would look at and say, \u2018Oh, this is clearly outside the lines of this legislation,\u2019\u201d Jeter said. \u201cTo some degree, I think this legislation is a solution in search of a problem.\u201d<\/p>\n

He is, however, concerned about the vagueness of some of the bill\u2019s language. While it defines \u201cdivisive concepts,\u201d it leaves room for individuals to disagree on whether certain curriculum or statements violate the law.<\/p>\n

That gray area, he said, may hamstring educators or school districts.<\/p>\n

\u201cThey give definitions, but the definitions in and of themselves are interpretable by different people,\u201d Jeter told the Observer. \u201cThat\u2019s the concern: it\u2019s the unintended consequences.\u201d<\/p>\n

State Superintendent of Public Instruction Mo Green and State Board of Education Chair Eric Davis raised similar concerns in a joint statement<\/u><\/a> Thursday.<\/p>\n

\u201cWe believe the law leaves educators with genuine questions about how to apply it,\u201d they said. \u201cIt restricts instruction on certain concepts while expressly and appropriately preserving the teaching of difficult history, including the historical oppression of people based on characteristics such as race, ethnicity and religion.\u201d<\/p>\n

Jeter served as a Republican state representative from 2013 to 2016 before taking a job with CMS. He said he\u2019s \u201cfrustrated\u201d that the legislature is voting on what he calls \u201cculture legislation\u201d while there still is not a state budget for this fiscal year, which starts July 1.<\/p>\n

The last time the General Assembly passed a comprehensive, two-year budget was 2023, meaning educators and other state employees went without raises this school year.<\/p>\n

Lawmakers announced the two chambers had reached a budget agreement May 12, including a reported average raise for teachers of 8%. However, the budget still has not been passed.<\/p>\n

\u201cWe\u2019ve got people that are struggling to make ends meet; we\u2019ve got people that haven\u2019t got a significant raise in years, and instead of making sure they get a budget done, the General Assembly is working on this,\u201d he said. \u201cI just don\u2019t know what we\u2019re fixing here.\u201d<\/p>\n
